This Privacy Notice describes the privacy practices of Darden Corporation, our affiliates and brands, including:
This Notice applies to personal information we collect from or about you during your visits to our websites, mobile applications, social media pages, or other digital channels, via your in-restaurant interactions with us or in-restaurant devices owned or controlled by us, or when you otherwise interact with us (collectively, the “Services”). It also describes how we use and disclose personal information, how we protect it, and your choices relating to your personal information.
The terms “we,” “our,” and “us” in this Notice refer to Darden, as the controller of personal information, together with its family of companies. It’s important to know that our websites or mobile apps may link content or sites operated by third parties not controlled by Darden or covered by this Notice. We recommend that you check the privacy statements of other sites you visit before providing any personal information. Please note as well that this Notice may not encompass the privacy practices of a Franchised Operator or Licensee of a Darden restaurant, Domestic or International, which are independently operated businesses. Lastly, additional notices and policies may apply to other relationships you may have with us. For example, we have a separate notice for Darden team members and job applicants, as well as a separate privacy notice for current and prospective franchisees.
By using our Services or otherwise providing personal information to us, you agree to our Terms of Use and our privacy practices as described in this Notice.
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is publicly available, de-identified, or aggregated.
We may collect Personal Information about you in a variety of ways depending on how you interact with our restaurants, websites, mobile applications, or other Services. For example, we may collect Personal Information directly from you, from devices you use to access our Services, and from other sources, such as our affiliates, service providers, and other parties. Cookies: Cookies are small text files that a website server stores on your computer or device. The length of time a cookie will stay on your device depends on whether it is a “session” or “persistent” cookie. Session cookies generally stay on your device until you stop browsing. Persistent cookies stay on your device until they expire or are deleted. We use both session cookies and persistent cookies on our websites. Pixels/Beacons: Tracking pixels (also known as web beacons) are tiny graphics embedded invisibly on a webpage that may be used to deliver or communicate with cookies, to count users who have visited certain pages, and to understand usage patterns. We use pixels on our websites or mobile apps to count how many users visit certain pages or take certain actions to collect or receive information from our websites, mobile apps and elsewhere on the Internet. We may use this information to improve our marketing programs and content, and target advertisements on our Services and/or other sites.
Mobile Device Information: When you use or access our Services from a mobile device, we may collect information such as your unique device ID and your location. If you download and use our mobile apps, we and our service providers may track and collect app usage data, such as the date and time the app on your device accesses our servers and what information and files have been downloaded to the app based on your device number, as well as any other Personal Information described in this Notice or specified by the app in its terms or notices.
Guest Wireless Access: When you connect to guest wireless internet service provided at our locations, we automatically log your activity on that connection, including the time, date, and duration of your connections and information that identifies your device. We use this information to protect our networks and detect potential unauthorized activities.
Analytics: We use analytics tools provided by Adobe, as well as other vendors. These analytics services may use cookies and other Tracking Technologies to help us analyze how you use our Services. Information collected or generated by these analytics services (e.g., your IP address and other usage information) may be transmitted to and used by these service providers for purposes such as evaluating your use of the Services and compiling statistics about activity on the Services, among other uses. This helps us understand how you use our Services so that we can improve the user experience and better tailor our marketing and promotions. Session Monitoring: Some of the technologies used on our website allow us and our service providers to monitor and analyze how visitors use our website in order to better understand user behavior and improve our Services. When you interact with us online, information related to your browsing behavior may be collected by us and our service providers.
Online Behavioral Advertising (OBA): There are ways we use OBA on third-party websites and mobile apps that are not affiliated with Darden. We may also use device information, particularly in mobile advertising, to help deliver our ads and measure ad campaign effectiveness. Darden and the companies we work with may collect certain information when you visit one of our sites or see our ads. Compiling and comparing this information creates a unique ID for individual devices and can be “matched” to the same information on other sites or mobile applications. Some companies we work with are also able to associate related devices into households based on common characteristics, such as IP addresses.
Interest-Based Advertising: The third parties we contract with may use cookies or other technologies to gather interest-based information to customize the ads you see. This information may be combined and linked with data from other sources. We may also use aggregate data to display ads or content that may interest you. You can personalize the ads you receive or opt out of ads from Google by visiting the Google Ads Settings page. Do Not Track Signals: Our websites do not respond to “Do Not Track” signals at this time.
Our Services may include online chat features to assist with answering questions and providing you with relevant information. When you participate in an interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using an online chat feature, you understand that our vendors may process the information obtained through the chat feature in order to provide services on our behalf.
We will retain your Personal Information for the purposes for which the information was collected, as outlined in this Notice, and to the extent necessary to manage your relationship with us, personalize and improve your overall customer experience, and to comply with our legal obligations, resolve disputes, and enforce our agreements or rights. Transfers of Personal Information Within the Darden Family: We may disclose your Personal Information within the Darden family of restaurants. The Darden Family currently includes Darden, Olive Garden, LongHorn Steakhouse, Cheddar's Scratch Kitchen, Yard House, The Capital Grille, The Capital Burger, Seasons 52, Bahama Breeze, Ruth’s Chris, and Eddie V's, as well as our affiliates and subsidiaries. Members of the Darden family who receive this information from us are not authorized to use or disclose the information except as set out in this Privacy Notice.
Targeted Advertising, Sales, and Sharing of Personal Information: Although we do not sell Personal Information in exchange for money, some of the ways in which we share Personal Information for targeted advertising may be considered “sales” or “sharing” under some US state privacy laws. Listed below are the categories of Personal Information we share for purposes of targeted/cross-context behavioral advertising or otherwise “sell” for non-monetary consideration:
The types of third parties to which Personal Information is sold or shared are third-party advertisers and some analytics vendors. The purposes for which we sell/share this information include showing you relevant ads while you browse the internet or use social media; marketing, advertising, certain types of analytics, or similar purposes. We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age. We do not sell or share Personal Information we obtain for text messaging programs (including opt-in consent data) with any third parties for those third parties’ own marketing purposes. Other Disclosures of Personal Information: We may disclose your Personal Information to third parties, including governmental authorities, to comply with any applicable law, regulation, legal process, or enforceable governmental request or if we believe in good faith that such disclosure is necessary to protect against harm to the rights, property or safety of Darden, our customers, or the public as required or permitted by law (especially in emergency situations). We may also disclose Personal Information to evaluate or conduct a merger, sale, or other disposition of some or all of our assets.
Opting Out of Targeted Advertising, Sales, and Sharing of Personal Information: In accordance with applicable state privacy laws, we provide the right to opt out of targeted advertising, sales, and sharing of your Personal Information. If you would like to opt out of targeted advertising, sales, and sharing via Tracking Technologies, please visit the Olive Garden website. Scroll down to the bottom of the page and click on the “Your Privacy Choices”.
Consumers in some states, such as California and Colorado, may also use the Global Privacy Control signal to opt out. If you choose to use a browser-based opt-out signal, you will be opted out of targeted advertising, sales, and sharing through Tracking Technologies, and will need to turn it on for each browser you use. Please note that if you opt-out of our promotional emails, we may still send you email messages related to your account or any Services you request from us. Unsubscribing from our promotional emails will not affect the level or quality of service we provide to you.
Text Messaging Preferences: You have the choice to opt in to receiving text messages and alerts on the mobile phone number(s) you share with us. You do not have to opt in to text messages and alerts to use and enjoy our Services. If you opt in, standard text messaging charges may apply. You may choose to opt out from our text messages and alerts at any time. To directly opt out, reply to the last text message you received from us on your mobile phone with the word STOP, STOP ALL, END, QUIT, CANCEL or UNSUBSCRIBE, and we will unsubscribe you from applicable text communications.
Mobile Device Location: If you use our mobile applications that collect precise location, you can change preferences on your mobile device to prevent the apps from collecting that information using your device settings.
You may have additional privacy rights under the law of the state in which you live. This section describes the rights of consumers in California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Texas, Utah and Virginia (collectively “Covered States”), as well as California vendors, franchisees, prospective franchisees and other business contacts. We maintain separate notices for California employees and job applicants.

Please note that we may need to authenticate your identity before your request can be processed. For authentication, you will be asked to log into your account or to provide 2-3 pieces of Personal Information that we will match against our records. In some states and for some types of requests, you may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the webform or toll-free number listed above. We will not discriminate against you if you choose to exercise any of your privacy rights under the Covered State privacy laws.

Right to Delete Your Personal Information: You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not to attempt to reidentify the information.
Right to Correct Inaccurate Information: If you believe that Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.
Right to Opt Out of Sales and Sharing of Personal Information: You have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for cross-context behavioral advertising. Right to Limit Use and Disclosure of Sensitive Personal Information: We do not use Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.
Right to Access and Data Portability: You have the right to confirm whether we are processing your Personal Information, to access your Personal Information, and to obtain a copy of certain Personal Information in a portable format. Delaware consumers may request a list of categories of Personal Information that were disclosed to third parties. Similarly, Oregon consumers may request a list of third parties to whom their Personal Information was disclosed.
Right to Delete: You have the right to request that we delete your Personal Information, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not attempt to reidentify the information.
Right to Correct: You have the right to request that we correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and our purposes for processing it.
Right to Opt Out: You have the right to opt out of the following uses of your Personal Information: (a) targeted advertising; (b) the sale of Personal Information; and (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements. California Notice of Financial Incentive
Summary: We offer rewards and benefits to those who choose to sign up for certain types of promotions, including our eClub. Participation in our eClub requires you to provide some Personal Information to us, such as Identifiers, Personal Records, Commercial Information, Demographic Information (e.g., date of birth), Internet or Other Electronic Network Activity Information, and Inferences. The eClub is designed to keep you up to date on offers, promotions, and news relating to your favorite Darden brands. From time to time, we may offer free food or drinks, coupons, special offers, or other discounts to consumers who sign up for our eClub or other promotions.
Material Terms: Participation in our eClub requires you to create an account and agree to our Terms of Use, which are linked on the eClub sign-up page and within the footer of each brand’s website.
How to Sign Up: You can sign up for the eClub on the participating brand’s websites.

Value of Financial Incentive: The value of the benefits provided varies as individuals take advantage of our financial incentive offerings to different degrees. For example, some of our brands provide a free appetizer when you sign up for the eClub, special offers on your birthday, and other special rewards. We estimate that the value of consumers’ Personal Information provided in connection with our eClub and other financial incentives is equivalent to the relevant expenses related to the collection and storage of that Personal Information. Any difference in price or benefits provided to customers who participate in our eClub or other financial incentives is reasonably related to the value of the Personal Information provided, taking account of the fact that the primary purpose of our promotions is to offer discounts and other benefits to our loyal customers.
Certain features on the Services permit interactions between our Services and certain third-party services, such as third-party social networks (“Social Features”). Examples of Social Features include enabling you to share content between our Services and a third-party service; “liking” or “sharing” our content; logging into the Services using your third-party service account; and otherwise connecting the Services to a third-party service (e.g., to pull or push information to or from the Services). If you use Social Features, information you post or provide access to may be publicly displayed on our Services or by the third-party service that you use. Similarly, if you post information on a third-party service that references our Services or brands (e.g., by using a hashtag associated with us), your post may be used on or in connection with the Services or otherwise by us and/or our affiliates. Also, both Darden and the third party may have access to certain information about you and your use of the Services and any third-party service.
From time to time, we may also offer public forums or similar features supporting content you submit, including text, photographs and videos or other file formats that are accessible to the general public. Unless we tell you otherwise, any information you disclose in these areas may become publicly available.
At no cost to you, we take commercially reasonable steps to protect Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Unfortunately, no security system is 100% secure, thus, we cannot guarantee the security of the information you provide to us via the Services.
Our online Services are not directed toward children under the age of 16 and we do not knowingly collect any Personal Information from children under the age of 16. If a child under 16 provides our online Services with Personal Information, we ask that a parent or guardian contact us as described below so that we may promptly delete the information.
Darden is based in the United States, and its collection and use of Personal Information is processed subject to US Data Protection laws. If you access our Services outside the United States, please be aware that Personal Information we obtain about you may be transferred to and processed in the United States or other jurisdictions outside your own, and may be accessed by the courts, law enforcement and national security authorities in those jurisdictions. By using our Services or otherwise providing your Personal Information to us, you acknowledge and consent to the international transfer and processing of your Personal Information as described in this Notice. Please be aware that the data protection laws and regulations that apply to your Personal Information transferred to the United States or other countries may be different from the laws in your country. If you do not want your Personal Information transferred to or processed or maintained outside of the country or jurisdiction where you are located, you should not use the Services.
We reserve the right to modify this Notice at any time for any reason at our discretion. Any change to this Notice will be posted on our Services and your continued use of our Services shall be deemed your acceptance of any modified terms.
